Member Agreement

This is a mutual agreement between all members of the Internet Movie Project. In the following agreement, a single member of the IMP is referred to as a "member", while the whole group of all IMP members is referred to as the "group-members" and the project itself as the "IMP". By joining the IMP, a member implicitely states that he/she has read and understands this agreement, and that he/she agrees to it and is willing to comply with it. This is also the case for members that are already in the project after the agreement is changed or initially installed: Their continuous membership in the project after being notified of the changes, states their agreement to and their will to comply with the changes.

I) Copyright

a) Member's copyright

  1. By submitting any artwork, be it visual (images, sketches, etc.), audio (music, sound effects, voices, etc.) or textual (scripts, slogans, etc.) to the IMP, the member is placing it in the public domain and is reqlinquishing all copyrights to it. The sole exception will be POV-Ray SDL files that contain a copyright notice and conform to the software copyright provision( I-a-2) of this agreement. Any POV-Ray SDL files submitted without a copyright notice will be placed into the public domain.

  2. The copyright of any software written for use in the IMP lies with the author of that software, if not explicitly stated otherwise by the author. However, with submitting a piece of software for use in the IMP, the author grants a irrevocable, unlimited and free license to the group-members to use the software for any IMP related work.

b) Third party copyright

By submitting any intellectual property to the IMP, a member states, that no third party copyright claims to this artwork or software exist, and that the copyright, lies solely with the member that is placing it into the public domain.

Each member agrees to use only fully licensed or otherwise legally purchased software in any projects or tasks related with the IMP.

All members do also agree, to only use hardware and software for any IMP related work which they either own themselves or for which they obtained permission to use for IMP related work. (For example office or university computers.)

Each member assumes the sole responsibility of his actions when using third party hardware or software or when submitting intellectual property for use in the IMP. No other member can be held liable in any way for damages or compensation or other legal responsibilities caused by a member not conforming to the above rules.

c) IMP copyright

All intellectual property that is created in a collaborate effort by the group-members, either as genuinely group-created art or out of member-submitted art (see Ia1), will be released into the public domain. IMP will not retain copyright of any material submitted to the project.

II Profits

The IMP is purely non-profit oriented. No member has any right to any compensation for his work inside the IMP.

III Legal age

With his application to become a member of the IMP, a member states that he is either of legal age in his country to be part of an undertaking such as the IMP, or that he has the expressed consent of a legal representative to join the IMP and be part of its projects.

IV Online Voting

All members agree, that a system for online voting will be put in place and, once it is in place, will be used for voting issues.

This agreement happens with full knowledge and understanding of the fact, that online voting with the current technology is not a safe procedure, with possibilities of fraud. However, this fact is accepted by the members because of the worldwide distributed nature of the IMP, which makes a failsafe voting system (within reasonable limits) an impossibility.

The members agree to advance their trust to any member or members who will be assigned the tasks of setting up such an online voting system, administering it and the voting-process, counting the votes and publishing the voting results. Those members can in no way be held legally or otherwise responsible for their work in relation with the online voting.

The rules on how votes are held (including the procedure and the time-frame) are to be published together with and easily accessible from the online voting system. Those voting terms are considered an extension of this agreement and fall under the same rules as this agreement.

The results of votes are binding to all members.

V Changes to this agreement

This agreement, or parts of it, can be changed under the following conditions: Changes can be proposed by any IMP member. A simple "yes" or "no" vote to accept or refute the proposed changes has to be held concurring to the general voting rules (see IV). The changes are accepted if more than 50% of the votes are "yes" votes.

Should parts of the agreement not be applicable under the legal system of a member's country, then those parts are to be replaced by a similar formulation in the spirit of the original one, that follows the requirements of the individual legal system, or they are to be ignored as not applicable, if such a replacement is not possible.

The validity of the rest of the agreement is not affected by such a change.
